Syracuse's 68 degree rule and the frozen rental

Inside the city line the person standing in the water is usually a tenant: an estimated 58.4 percent of occupied Syracuse homes are rented, the highest share in the metro. That changes the first hour. The tenant closes the main valve by the basement meter and tells the owner in writing, and the owner authorizes the repair, because the Syracuse Property Conservation Code makes the owner furnish heat and hot water and hold habitable rooms at 68 degrees through the cold months. A pipe that froze because the heat failed is a heat problem first, so report both. Shutting the water off to stop a burst is exactly the emergency the code allows; leaving an occupied unit dry for days afterward is not, which is why the temporary repair matters as much as the shutoff. If water is coming up in the street or the whole block has lost pressure, it may be the city's side: close to half of the city's recorded main breaks fall between December and March, and the Water Department takes emergency calls at any hour on 315-448-8360.

What Syracuse city code puts on the owner of a rental

Section 27-54 of the Syracuse Property Conservation Code requires heat in occupied buildings sufficient to hold habitable rooms, kitchenettes, bathrooms and toilet rooms at 68 degrees Fahrenheit, measured two feet from exterior walls and five feet above the floor, from September 15 to May 31 whenever the outside temperature falls below 55 degrees, with heating equipment capable of doing so at an outside temperature of minus 10 degrees.

Section 27-11 of the Syracuse Property Conservation Code requires the owner to maintain all electrical, plumbing and other facilities supplied by the owner in good working order and to furnish adequate heat and hot water, except in units with individual heating or hot water systems, which must still be capable of providing adequate heat and hot water. Section 27-52 requires water heating facilities capable of delivering at least 2.5 gallons per minute at not less than 110 degrees Fahrenheit at every required fixture.

Section 27-14 of the Syracuse Property Conservation Code forbids any owner, occupant or responsible person to remove, shut off or discontinue any service, facility, equipment or utility the code requires for an occupied dwelling unit, except for necessary repairs, alterations or emergencies. Section 27-13 makes occupants responsible for keeping plumbing fixtures clean and sanitary and for reasonable care in their operation and use.
