Sewage Backing Up in a Camillus Apartment: Who Puts It Right

A backup in a Camillus rental is the owner's to fix under New York's habitability rule, unless the tenant caused it, so the first hour is about stopping it and showing what happened.

Sewage and Overflows quote in Camillus

Tell us what the water is doing, whether it has stopped and whose home it is. A person reads every request and matches it to a licensed, insured plumber for the part that cannot wait. We cannot promise how soon a request sent at night is read, so close the main shutoff first.

Would you rather talk it through? Call (315) 640-3590.

Five quick questions about what the water is doing and whether it has stopped, then your details. It takes about a minute, and the answers go to a person who reads them.

Question 1What is happening right now?
Question 2Has the water stopped?

If water under pressure is still running, closing the main shutoff inside the house, where the supply pipe comes through the wall, stops it. Leave the valve at the street alone: only the water utility's own staff may operate it.

Question 3Is anything near electricity or gas?

If you smell gas, leave the house first, then phone the gas utility or 911 from outside. Do not touch water that is near outlets or the electrical panel.

Question 4Whose home is it?

In a rental the landlord is usually responsible for the plumbing and for keeping hot water running, so it helps to know who needs to hear about this.

Question 5Are you thinking of making an insurance claim?

New York's insurance regulator advises keeping receipts for temporary fixes and holding off permanent repairs until the insurer has had the chance to inspect. Knowing this now shapes what gets done tonight and what waits.

What New York's lease rule and the Camillus rental share mean for a backup

ACS 2020 to 2024 estimates put 375 of the Village of Camillus's 728 occupied units, 51.5 percent, as renter occupied, the highest share of any village in this metro, while the surrounding Town of Camillus is 20.6 percent renter occupied with a median year built of 1966.

New York Real Property Law section 235-b provides that in every written or oral residential lease the landlord is deemed to warrant that the premises and common areas are fit for human habitation and free of conditions dangerous, hazardous or detrimental to life, health or safety, except where the condition was caused by the misconduct of the tenant. Any agreement by a tenant waiving or modifying these rights is void as contrary to public policy.

The NY DFS guide states that a landlord does not insure a tenant's personal property, that by law the New York building owner insures the dwelling itself, and that if water damage ruins a renter's belongings the renter is not protected unless they buy renters insurance. It lists water damage from plumbing failure, appliances and other accidental discharges among the losses renters policies typically cover, and sewer and drain backup as coverage a renter may need to add.

Onondaga County WEP asks residents with sewage backing up to call 315-435-3157, which it answers at any time, every day, for properties connected to the public sewer inside the Consolidated Sanitary District. For City of Syracuse properties it directs the call to the City Department of Public Works on 315-448-CITY, 315-448-2489, and outside the district to the town or village, usually its DPW. Properties not on public sewer are told to contact a licensed plumber or service expert.

Local Context

The Camillus tenant, the owner and the rising drain

Sewage is coming up into a Camillus apartment through the tub or a floor drain. Stop all water use in the unit, keep children and pets away, and phone WEP on 315-435-3157, since the village and the Town of Camillus are both in the county sewer district, to rule out the public side. Then tell the owner in writing. New York law reads a promise into every residential lease, written or oral, that the home is fit to live in and free of conditions dangerous to health, and a sewage backup is exactly that kind of condition. The one exception is a problem the tenant caused.

Deciding

Proving cause and covering belongings after a Camillus backup

With about half of Camillus village households renting, most backups here start a conversation about cause. A wad of wipes in the trap reads differently from a blockage in the pipe outside, so a photograph of whatever the plumber pulls out is worth more than any argument later. Belongings are a separate question. New York's regulator notes that sewer and drain backup is coverage a renter may need to add to a renters policy, so a tenant's damaged things may not be covered even with a policy in place. Check before cleanup, while the damage can still be seen.

  1. Public side check before the plumber

WEP inspects from the cleanout or vent cap out to the road. If the public sewer is the problem, the fix is not the tenant's or the owner's.

  2. Photograph what comes out of the drain

Cause decides who pays under the habitability rule. A picture of the blockage settles more than a dispute can.

  3. Read the renters policy for a backup add-on

Sewage and drain backup is often an extra on a renters policy. Knowing whether yours has it decides what to photograph before cleanup.

Questions

Camillus questions about sewage backups in rented homes

Can my Camillus landlord make me pay for a sewer backup?

Only if the tenant caused it. New York's habitability rule excepts conditions caused by the tenant's misconduct, and any lease clause waiving the rule is void. That is why the photographs of the drain and what came out of it matter.

Is it safe to clean up sewage myself?

Keep it limited. The CDC advises rubber boots, rubber gloves and goggles if sewage is involved, and keeping children and pets away. For more than a small spill, the EPA's advice is a professional experienced in contaminated water. That cleanup is a separate job from clearing the drain.
